Please read these Terms & Conditions carefully in advance . Object of these Terms and Conditions is the Ocean Re-CREATION Challenge (short: ORCC). The ORCC is organised by the TransMarTech Schleswig-Holstein GmbH (short: TMT).
The Terms and Conditions shall apply to:

Applying for the ORCC via online registration on the website ocean-re-creation.de, provided by TMT.

Signing up for the OCC as a mentor via online registration on thewebsite ocean-re-creation.de.
-
Registering and physical presence at the ORCC site in Kiel between 13 and 17 September 2021.

Registering for and accessing the online communication platform Rocket.Chat: chat.transmartech.sh provided by TransMarTech Schleswig-Holstein GmbH Accessing the ORCC platform https://ocean-re-creation.devpost.com/ in order to submit a hackathon pitch on behalf of a ORCC-Team (the “Hackathon Submission”, or “Hackathon Submissions”);

Accessing the website, Hackathon Platform, Event Platform, or the Communication Platform (jointly the "Platforms”); and
-
Participating in the ORCC .
Your application for, access to, participation or involvement in the ORCC is conditioned on your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, applicants and others who attend the ORCC events, access or use the platforms, and to all applicants and participants, local organisers, jury members, and mentors of the ORCC.
With accepting these Terms and Conditions, you confirm that you are of legal age (18 years or older) and that you are legally capable of entering into binding contracts.
By applying for, accessing, or participating in the ORCC, or by accepting the invitation to be part of the ORCC’s local organisation team, mentor pool, or ORCC Submissions Jury, you agree to be bound by these Terms and Conditions. If you disagree with any part of these Terms and Conditions, you may not apply for or participate in the ORCC, nor become part of the local organisation team, mentor pool or Hackathon Jury.
#1 Introduction
The ORCC is an open innovation Hackathon format with the intension of solving pre-defined challenges. The overall goal is developing solutions in interdisciplinary teams for current challenges in coastal and marine protection. With your help and knowledge we want to actively promote innovative ideas: from basic research over conceptual projects to specific implementation. The objective is to make an active contribution to solving global problems at local level.
#1.1. Participants
Participants are individuals who have registered to participate in the ORCC. Each person is part of a team. Each individual can only be part of one team. Each team is represented by a leader (the “Team Leader”). The team leader is the formal contact to the organisation team. This applies to the Hackathon Submissions and any profit , benefit or recognition that may result from the Hackathon Submission. Any planned or unplanned changes to the composition of a team have to be announced to the organisation team by the team leader without delay. Changes to the team composition may result in: fusion of teams, splitting of teams or the formation of new teams. The most suitable form will be decided between the organisation team and the team leader.New formed teams will have to appoint new team leaders.
#1.2. The Jury
The jury (the “Jury”, “Jury Member”, or “Jury Members”) consists of experts supporting TMT. Their task is to select the teams eligible for prizes, if any, during the ORCC. Jury members are natural persons
#1.3. The Mentors
Mentors are individuals, selected by TMT. Their task is to provide mentoring to the teams during the ORCC. Mentors are natural persons but can be represented by a legal entity.
#1.4. Content
Our digital platforms allow all participants to post, link, store, share and otherwise make information, texts, graphics, videos, or other material available . Using these platforms, participants are responsible for the content they are adding, including its legality, reliability, and appropriateness.
By posting content to the platforms, participants grant us the right and license to use, modify, perform, display, reproduce, and distribute the content on and through the ORCC platforms. Participants retain any and all rights to any content they submit, post or display on or via the platforms and are responsible for protecting these rights. Participants agree that this license includes the right for TMT to make the content available to other users of the platforms, who may also use the content subject to theseTerms and Conditions.
Participants represent and guarantee or ensure that:

They have the right to use the content and grant TMT the rights and license as provided in these Terms and Conditions.

The posting of content on or via the above mentioned platforms does not violate privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.
Further, participants guarantee that:

The content will not cause participants or TMT to breach any law, regulation, rule, code or other legal obligation.
The content will not or could not be reasonably considered to be obscene, inappropriate, defamatory, disparaging, indecent, seditious, offensive, pornographic, threatening, abusive, liable to incite racial hatred, discriminatory, blasphemous, in breach of confidence or in breach of privacy.

The content will not be be used for unsolicited, undisclosed or unauthorised advertising.

The content does not contain software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware or telecommunications equipment.

The content does not bring TMT or the above mentioned platforms into disrepute.
Participants agree to keep all records necessary to proof that the content does not violate any of the requirements.. All necessary records are made available upon TMT’s reasonable request. TMT is under no obligation to regularly monitor the accuracy or reliability of the content incorporated into the platforms. TMT reserves the right to modify or remove any content at any time.
#1.5. Code of Conduct
Any activities promoting or related to alcohol, tobacco, religion, politics, intolerance, violence, firearms, pornography, obscenity, gambling, or illegal drugs are explicitly excluded from further participation in the ORCC.
TMT is dedicated to providing a harassment-free experience for everyone regardless of race, creed, colour, ethnicity, nationality, religion, sex, sexual orientation, gender expression, age, physical appearance, body size, disability, or marital status. TMT does not tolerate harassment of hackathon participants in any form.
Sexual language and imagery are not appropriate for any hackathon venue, including hacks, talks, workshops, parties, social media and other online media.
Any person, mentor, organiser, member of a team or jury violating these rules will be sanctioned or expelled from the ORCC and the location. The decision will be declared by TMT.
#2 Participating as an individual or team
#2.1. Sign-Up
To begin participation in the ORCC, signing-up via a form on ocean-re-creation.de will be required. During this process, we will ask you to share personal data such as your name and e-mail, for the purposes of contacting you, to validate your information regarding your participation in the ORCC. You will be asked to read and accept these Terms & Conditions and the Privacy Policy before registering as a person. The personal data,you share during user registration will not be shared with any parties other than the Organisers, the Jury Members, and the Mentors, solely for the purposes of executing the ORCC. Explicit consent for any other uses of your personal data is requested during the registration process.
#2.2. Right of Participation
Only natural persons of legal adult age (18 years or older) are allowed to participate. Participation in the in the ORCC is accepted on the condition of compliance with the eligibility criteria to participate. The ORCC welcomes all participants and shall not discriminate on the basis of race, creed, colour, ethnicity, nationality, religion, sex, sexual orientation, gender expression, age, physical appearance, body size, disability, or marital status.
Participation of a person at the ORCC is accepted on the condition of compliance with the following additional eligibility criteria, namely:

The Person must be part of a single team to take part in the ORCC;

The choice of which team each person belongs to must be communicated to the organizers by each person via communication platform, the latest at the start of the Hackathon Weekend;

The teams should ideally have at least three (3) team members, and can go up to a maximum of eight (8) team members;

Hacker Teams must choose one challenge to work on, the latest at the start of the Hackathon day one (1);
Persons and teams commit to the following rules during the ORCC:

Solutions for the challenges should not be worked on before the official start date September 13th at 9am. Teams that violate this rule will be automatically disqualified. Please do not begin hacking before Monday September 13th 2021 at 9am.

To ensure a level field for all contestants, all code or prototypes or business models must be created by the team, during the Hackathon week. You are permitted to use publicly available or openly licensed APIs, SDKs, frameworks and other software libraries for your project; also you might be given access to hardware that will be free for usage.

Any software development tools and/or programming language can be used.
TransMarTech will not reimburse any costs arising during the participation in the ORCC.
#3 Submitting your challenge solution (project)
All submissions must be handed in via https://ocean-re-creation.devpost.com/ until September 17th 23:59pm
Each team is required to submit a single recorded video pitch of maximum two (2) minutes; and
A single completed project page on https://ocean-re-creation.devpost.com/ containing the following:

All team members with brief biographies and their roles in the team;

Optionally, a link to a video or screen capture of the prototype;
-
Optionally, a link to the Github repository with the open source code.
Only upon completion of all required fields, your application is considered complete. You are encouraged to submit your application before the deadline in case IT issues arise. Each team can submit only one project submission.
Hackathon Submissions that have not been submitted, or Hackathon Submissions submitted after the above-mentioned deadline, are not eligible for evaluation and will under no circumstances be reviewed by the Jury.
All submissions will be evaluated and scored by the Jury on three criteria:

Relevance to the hackathon theme and challenges (1/3 weighting in score);

Innovativeness, scalability and technological value created for future users and customers (1/3 weighting in score); and
-
Quality of the team, including technical expertise, business expertise, commitment to the project and ability to pitch (1/3 weighting in score).
We may terminate your participation in the ORCC in written (by letter or e-mail) if you breach these Terms & Conditions. This termination will take effect immediately after such termination letter or e-mail has been sent, with the date indicated on post or time stamps as legal basis. Upon termination, your right to benefit from the ORCC will immediately cease.
If you wish to terminate your participation to the ORCC, you may do so in written (by letter or e-mail). This termination will take effect immediately after such termination letter or e-mail has been sent.
All provisions of the Terms & Conditions which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, limitations of liability and Non-Disclosure Agreements.
We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension, or any other actions taken by us in connection therewith.
